The supreme court of the United States (U.S) has a vital role in the sates government system. The constitution gives them the authority to scrutinize, when essential, both the actions of the president and the Congress. However, they are more eager proclaim to the acts of the Congress as unlawful than the president’s actions. Therefore, in this paper, I will elaborate on the reason why the justices of the Supreme Court are seen to be more eager to proclaim the actions of Congress as unlawful than to declare that presidential actions were unconstitutional. Additionally, I will talk about the instances in the past when the supreme court’s justices have checked the presidential power.
The U.S Supreme Court gives the final judgment in all the laws that the Congress passes and, in some instances, it has been seen declaring the laws passed by the Congress unconstitutional. For example, in the case of Marbury vs. Madison in 1803. The major reason why the Supreme Court declares the Congress acts more unconstitutional as opposed to the president’s acts is that the judges are selected by the U.S president. The sitting president usually appoints the judges who are then vetted by the Senate. Since their appointment comes from the president, this limits them from declaring his actions unconstitutional.
