Jenson v. Eveleth Taconite case
The Jenson v. Eveleth Taconite is a case in which the US appeal court in the 8th circuit affirmed the findings of the district court that the company which was an employer was liable of creating a hostile working environment that perpetrated sexual harassment against women (Mignon, 2013). This was a class of action which was made on behalf of some women. In the suit, the women demonstrated that the mines were sexualized against them as there was the use of highly abusive language and visuals which portrayed women as sexual objects. Although no remedies were ordered to specific victims, the court declared that there were both moral and ethical breaches which could have been avoided by the company.
The ethical breach in the case was the discrimination which was meted on women. The women were treated less favorably compared to men. The employer did not have proper procedures for the victims to forward their complaints (Mignon, 2013). Abusive language was also used against women. All these practices amounted to discrimination which is an ethical breach. This could have been avoided if the company had a policy against sexual discrimination and proper procedures for those affected to report.
